What Clause 10.1(iii) asks for

From NHAI's Revised Standard EPC Agreement (updated till 25 April 2022). Your signed agreement and its schedules decide.

“Within 30 (thirty) days of the Appointed Date, the Contractor shall submit to the Authority and the Authority's Engineer a programme (the ‘Programme’) for the Works, developed using networking techniques, for review and consent of the Engineer…”

The same clause asks for a revised programme “whenever the previous Programme is inconsistent with the actual progress or with the Contractor's obligations”, so the programme has to be easy to update every month.

Why the programme matters

0.05% a day

Damages on the Contract Price once a Schedule-J date is missed by more than 30 days (Clause 10.3(ii)). On a ₹50 crore contract that is ₹2.5 lakh a day.

10% cap

Beyond 10% of the Contract Price in damages, the contractor is “deemed to be in default…having no cure” and the Authority may terminate (Clause 10.3(iii)).

90 days late

On contracts of ₹300 crore or more, more than 90 days late on completion bars the contractor from bidding for NHAI projects until the Completion Certificate (Clause 10.3(iv)).

Schedule-J sets Milestones I, II and III at 35%, 60% and 85% of the construction period, with stage payment statements of at least 10%, 35% and 70% of the Contract Price, plus all bridges started by Milestone II and all project facilities started by Milestone III. A programme that meets the completion date can still miss Milestone II, so we check each one.

2. We confirm format, milestones and a fixed price

Primavera P6 or MS Project and the version you use, your client's coding rules, the start or Appointed Date, and your crews and equipment. Work starts only after you confirm.

3. We build and check the programme

Work breakdown by location, chainage or floor; durations from your quantities; logic with curing and review lags; Indian calendars with monsoon windows; critical path, cost loading and cash flow. Checked for open ends, logic, calendars and milestone dates before it leaves us.

4. You submit

You get the P6 XER or MS Project file, a PDF bar chart, the S-curve and cash flow in Excel, and a basis report listing every assumption. One revision after your Engineer's comments is included.

What the programme is based on

A SiteSetu programme is a planning aid built from your drawings or BOQ, the inputs you confirm (start date, crews, formwork sets, working calendar and contract milestones) and standard productivity norms: the CPWD Delhi Analysis of Rates 2023 and IS 7272 for building work, and the MoRTH Standard Data Book for roads and bridges, adjusted by the site and season factors listed in the basis report. It does not guarantee completion dates, acceptance by your Engineer-in-Charge or Authority's Engineer, or any extension of time, and it is not legal advice. You approve the inputs before we finalise.

Frequently asked questions

Is Primavera P6 mandatory for NHAI EPC works?

Not under the model agreement: Clause 10.1(iii) asks for a programme "developed using networking techniques" and names no software. Many Authority's Engineers and project units work in Primavera P6, and some contracts name it in their special conditions, so we deliver an XER unless your contract or your Authority's Engineer asks for something else.

What is the Appointed Date?

The model agreement defines it as "the date declared by the Authority as the project commencement date with the consent of the contractor". The 30-day programme deadline, the Schedule-J milestone days and the Scheduled Completion Date are all counted from it.

What goes into Part III of the programme?

A monthly cash flow forecast. We cost-load the programme from your BOQ by Schedule-H stage, so the forecast follows the planned progress and can be checked against the Schedule-J stage-payment thresholds.

How often must the programme be revised?

Clause 10.1(iii) asks for a revised programme "whenever the previous Programme is inconsistent with the actual progress or with the Contractor's obligations". In practice that means a monthly update and a formal revision whenever the site falls behind or the obligations change.

What happens if a Project Milestone is missed?

Under Clause 10.3, once a Schedule-J date is missed by more than 30 days, damages of 0.05% of the Contract Price per day run from that date until the milestone is achieved, except for force majeure or reasons solely attributable to the Authority. They are refunded, without interest, if the project is completed within the Scheduled Completion Date including any extension, and total damages are capped at 10% of the Contract Price.

Is a HAM project different?

Yes. In NHAI's hybrid annuity concessions the construction schedule is set against the agreement's project completion schedule and reviewed by the Independent Engineer, and clause numbers vary by agreement. Send us yours and we programme to its milestones.

Do you do the monthly updates for the Authority's Engineer?

Yes. We update the programme to the status date, show variance against the baseline, re-forecast the cash flow and flag milestones at risk. For P6 programmes the monthly update starts at ₹4,999, and the first month is free with the programme.

What does the NHAI programme cost?

In Primavera P6, ₹7,999 for works up to ₹5 crore, ₹29,999 up to ₹100 crore and ₹49,999 up to ₹300 crore; larger contracts are quoted. These are launch prices till 31 Dec 2026, excluding GST.
